Mesothelioma - The Law & You

Mesothelioma law includes laws that regulate employee exposure to asbestos, mesothelioma law that allows people with mesothelioma to seek compensation for their illness, and new laws that Congress is currently debating with regards to how mesothelioma victims, or their decedents can be compensated for their medical expenses, pain and suffering, and possible loss of future income.

All mesothelioma law involves the risk or actual development of mesothelioma. Mesothelioma is a form of cancer that affects the mesothelium in the body. Mesothelium is the lining that surrounds most organs. Pleural mesothelioma is cancer of the lung's mesothelium. Peritoneal mesothelioma involves the lining of the abdomen. These cancers develop almost exclusively as a result of exposure to harmful levels of asbestos

Over 1.3 million people are exposed to asbestos in their work environment each year. Building, construction, railroad, factory, automotive, and shipyard industry employees are all potential victims of asbestos related illness and are the people protected by mesothelioma law. Construction workers have the highest risk of exposure to asbestos.

The Control of Asbestos at Work Regulations 2002 (CAW 2002) make it very clear that if you own, occupy, manage, or have responsibility for non-domestic premises which may contain asbestos, you will have a legal duty to either manage the asbestos risk or will have a legal duty to co-operate with whoever manages that risk.

A common misinterpretation of Regulation 4 of CAW 2002 is that companies have to survey their premises to comply with the requirements. This is not the case - the requirements are a DUTY TO MANAGE the risks associated with asbestos in the workplace.

The essence behind this duty is to prevent exposure to asbestos, particularly when the exposure is through ignorance. Informing staff and visitors is not where this ends - for example, contractors attending sites to carry out maintenance work, install cabling or refurbish an area need to be informed of any asbestos risk AND a record of their visit and acknowledgment of your instruction are also required.

A permit to work system has to be introduced or extended to cover the regulations, and the permit can only be issued by the "authorising person" (being a person who authorises any maintenance work in the building). Any presumed, or confirmed, asbestos information also has to be made available to the emergency services.

When identifying asbestos, the rule is that of assumption - unless you can prove materials do NOT contain asbestos then you HAVE to assume it does, and therefore treat it as though it does. This can lead to expensive testing and surveying and hence the need to assess the situation first with a materials risk analysis and an understanding of the location/condition.

Many newer buildings are less likely to have asbestos within them but it is important to establish what is, or is not, there, to record the findings, and incorporate them into a management plan. Initiating the basis of a plan and booking a survey will show good intent to compliance and is the first step to a safer workplace for all.

The penalties for non-compliance can be extremely strong and claiming ignorance of the regulations is no defence. The penalties for non-compliance with the Control of Asbestos at Work Regulations 2002 can be as follows:

HSE inspectors can issue prohibition notices which can close areas or entire sites Companies can be fined an unlimited amount and individuals can be fined ?20,000. Responsible individuals can be imprisoned for up to two years Directors of companies can be disqualified As you can see, the law related to asbestos is very strong. The good news though is that it costs you nothing to have an impartial initial discussion with a lawyer.

Who Can be at risk for Mesothelioma?

Mesothelioma is a rare disease caused as a result of malignant cancerous cells lining the patient's body cavities such as chest, abdominal region or the area surrounding the heart. It is typically associated with exposure to asbestos which has been documented in as many as 70-80% of all mesothelioma cases. This disease is very difficult to assess consistently due to the great variability in time before diagnosis and the rate of progression of malignant mesothelioma.

Even insignificant exposure to asbestos (commonly reported in such work environments as asbestos mills, mines, shipping yards, some older Navy ships or patients. homes) is known to result in mesothelioma, which in many cases does not occur for decades after initial exposure to this cancer-causing substance. In the recent years as many as 2000-3000 cases of have been diagnosed per year. It is also known that family members of workers exposed to asbestos can contract this disease through exposure to the worker's clothing. Smoking greatly increases the risk of contracting this disease.

Mesothelioma, this is a deadly disease that has been in the spotlight for the last decade. Sad but true, the number of under-regulation usage in years past still shows that we are paying for it today. It can be safely said that almost everyone in the world has been exposed to asbestos at one point in their life. Because of the unique nature of the disease, even those who have suffered only small exposure are at risk of contracting the disease. In effect, virtually everyone has some risk of contracting Mesothelioma.

But while this sort of statement is true, it is also open ended and up for debate. While it is certainly true that individuals who have been exposed to small amounts of asbestos for relatively short periods of time have contracted the disease, this is a rarity in most cases. In fact, the vast majority of Mesothelioma cases involve individuals who were exposed to airborne asbestos fibers for an extended period of time.

Most research shows that the industries most in danger of prolonged exposure and thus of contraction are shipbuilding trades, asbestos mining and milling, textile work, insulation work, and brake repair personnel workers. There are, however, some other similar factors which can affect the likelihood of contracting this disease. Among these is exposure to radiation. There have been causes in which individuals who were exposed to radiation have subsequently displayed signs of and contracted mesothelioma. However, the studies to attempt to verify this correlation have not proven out this claim in a strong way.

Another more certain and proven cause of the disease was the taking of the Polio vaccines. Some batches of this vaccine were contaminated with Simian Virus 40 which has been detected in a host of rare cancers including Mesothelioma. Some individuals who have been exposed to long periods and high quantities of asbestos have not contracted the disease. As a result, doctors have concluded that genetics play a major role in determining whether or not patients contract the disease. Unfortunately, the gene variability which offers some resistance to the disease also means that some are particularly vulnerable to asbestos exposure.

Putting Mesothelioma Into Perspective

Mesothelioma is an uncommon form of cancer, usually associated with previous exposure to asbestos. Of course, saying it's uncommon is hardly comforting to someone dealing with this cancer or who has a loved one suffering from it. In this disease, cancerous cells develop in the mesothelium, which is a protective lining that covers most internal organs of the body. Its most common site is the outer lining of the lungs and chest cavity, known as the pleura, but it may also occur in the lining of the abdominal cavity, called the peritoneum or a sac that surrounds the heart, called the pericardium. These sensitive tissues become very irritated as a result of the cancer's progression.

The most common reason people develop mesothelioma is from asbestos exposure with those who have worked on jobs where they inhaled asbestos particles. Some flooring adhesives also contained asbestos fibers and even pipe insulation was made with asbestos for a time. People exposed to these fibers have a greater risk of developing this cancer, but it is not a certainty.

Mesothelioma clinical symptoms may not appear until 30 to 50 years after exposure to asbestos. This increased the difficulties associated in legal claims because the time between the exposure and the disease was so long.

Shortness of breath and pain in the chest are often symptoms of pleural mesothelioma. Peritoneal mesothelioma clinical symptoms include weight loss and muscle wasting. Abdominal swelling and pain due to a buildup of fluid in the abdominal cavity are also common symptoms associated with Peritoneal mesothelioma. Other clinical symptoms of peritoneal mesothelioma may include bowel obstruction, blood clotting abnormalities, anemia, and fever. As the cancer spreads beyond the mesothelium, symptoms may include pain, trouble swallowing, or swelling of the neck or face. These symptoms may be caused by mesothelioma or by other, less serious conditions and should always be evaluated by a medical professional for a proper diagnosis.

As there is no universally agreed protocol for screening people who have been exposed to asbestos, early detection is difficult. Discuss any possible risk factors you may have with a doctor if you believe you may have been exposed to asbestos.

Biologically, asbestos fibres have been shown to alter the function macrophages, which are specialized cells of the immune system. This ultimately creates conditions which favor the development of mesothelioma. Macrophages generate increased amounts of hydroxyl radicals, which are normal by-products of cellular anaerobic metabolism. However, these free radicals are also known as clastogenic and membrane-active agents thought to promote the carcinogenic effect of asbestos. These free radicals can participate in the oncogenic process by directly and indirectly interacting with DNA, modifying membrane-associated cellular events, including oncogene activation and perturbation of cellular antioxidant defenses. Because of these factors, healthy levels of dietary antioxidants may improve the bodily capacity to manage the progression of these free radical effects, but it should be noted that nutrition is not regarded as medical intervention for this disease and dietary improvements should be viewed as complimentary benefit by properly nourishing the body and avoiding the more common and more harmful foods which are so common in the average diet in industrialized countries.

Asbestos may also possess immunosuppressive properties and is an issue which is under great study. Again diets, that promote proper immune function may provide some benefit to a person at risk, or deal with the effects of mesothelioma, but it is not considered medical intervention by any means.
